The
Fair Competition Act (FCA) was enacted to protect competition
in Jamaica. We need competition in the economy as it stimulates
innovation and efficiency among businesses; it enables consumers
to buy goods and services of the highest standards at the best
possible prices. The Act does not protect competitors, it protects
competition.
 |
The
Act focuses primarily on Anti-Competitive (or uncompetitive)
practices, which can be defined as activities which lessen competition
in the production, sale or purchase of goods and services. These
activities result in reduced opportunities for businesses to
participate in the economy and deprive consumers of the wide
choice of goods and services due to them. The article "Prohibitions
under the FCA - Anti-competitive Practices"
gives an overview of the anti-competitive activities disallowed
by the Act.
